29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired: The employer is failing to ensure that all employees are protected from fall hazards when using a defective ladder to access and egress the upper landing surface. The most recent occurrence was evident during the inspection conducted on August 19, 2019 at a worksite located at 1515 S. 70th St., Lincoln, NE 68506. Two employees were using a 24-foot fiberglass extension ladder to access the upper landing surface where trusses were being installed. The ladder was missing a slip-resistant pad on the bottom of one of the footings. While an employee was climbing up the ladder it slipped out causing the employee to fall approximately 12 feet to the concrete ground sustaining fatal injuries.
