29 CFR 1910.269(p)(4)(ii): A designated employee other than the equipment operator shall observe the approach distance to exposed lines and equipment and provide timely warnings before the minimum approach distance required by paragraph (p)(4)(i) of this section is reached, unless the employer can demonstrate that the operator can accurately determine that the minimum approach distance is being maintained: The employer is failing to protect employees from electrical shock hazards associated with line-clearance tree trimming operations. This was most recently documented on or about July 2, 2019 at the Asplundh Tree Expert, LLC jobsite located between 1430 & 1444 N. Fairview Ave. Wichita, Kansas 67203. The employer did not ensure a designated employee observed and provided timely warnings as an employee operating an aerial lift approached conductors closer than 10 feet or the minimum approach distances required by paragraph (p)(4)(i) of this section.
