OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards: An employee operated a Caterpillar excavator (Company No. E650, Model 320) on a hillside without ensuring, when possible, to operate the machine up slopes and down slopes with the final drive sprockets facing down the slope. Abatement: Among other methods, one or more feasible and acceptable methods of abatement would be to re-train and re-qualify operators on the manufacturer's recommendations to ensure when possible, to operate the machine up slopes and down slopes with the final drive sprockets facing down the slope.
