29 CFR 1910.1053(f)(3): In addition to the requirements of paragraph (f)(1) of this section, the employer did not comply with other OSHA standards, when applicable, such as 29 CFR 1910.94 (Ventilation), 29 CFR 1915.34 (Mechanical paint removers), and 29 CFR 1915 Subpart I (Personal Protective Equipment), where abrasive blasting was conducted using crystalline silica-containing blasting agents, or where abrasive blasting was conducted on substrates that contain crystalline silica: The employer is failing to prevent employee exposure to silica hazards in the workplace. The condition was most recently documented on May 21st, 2019, at 700 S Rogers Rd #A, Olathe KS 66062. Employees engaged in gun repair activities were exposed to silica hazards in that the employer did not ensure they were in compliance with the following contained in 29 CFR 1910.94: 1) 1910.94(a)(5)(ii)(b): Abrasive blasting respirators were not worn by operators when using silica sand in manual blasting operations where the nozzle and blast are not physically separated from the operator in an exhaust ventilated enclosure. 2) 1910.94(a)(5)(iii)(b): Dust-filter respirators were used for continuous protection where silica sand is used as the blasting abrasive. 3) 1910.94(a)(7): Dust was allowed to accumulate on the floor and edges of the blasting enclosure and dust spills were not promptly cleaned up.
