29 CFR 1910.1053(g)(1): Where respiratory protection was required by this section, the employer did not provide each employee an appropriate respirator that complied with the requirements of this paragraph and 29 CFR 1910.134: a. On or about January 16, 2019, an employee who was required to wear a NIOSH approved N95 filtering half face tight fitting respirator while cutting, shaping, and finishing quartz, marble, and other exotic stone work for countertops in the fabrication area, was exposed to Respirable Crystalline Silica at a Time Weighted Average (TWA) of 1096.9 micrograms per cubic meter (µg/m3), 22 times the permissible exposure limit of 50.0 µg/m3. The sampling was performed for 415 minutes on January 16, 2019. The respirator worn by the employee was not appropriate to provide protection required by the standard.
