29 CFR 1926.1412(f)(4): If any deficiency is identified, an immediate determination must be made by the qualified person as to whether the deficiency constitutes a safety hazard or, though not yet a safety hazard, needs to be monitored in the monthly inspections. The employer is failing to protect employees from struck-by hazards. This was most recently documented on or about December 7, 2018 at the establishment located at 7436 1000 Road, in Fredonia, Kansas. Employees were exposed to struck-by hazards in that the Terex Crane (Model HC165, Serial-AC4221) used for raising trusses was found to have deficiencies and a determination was not made as to whether the deficiency constituted a safety hazard or needed to be monitored during monthly inspections.
