Text For Citation: 01 Item/Group: 001 Hazard:

Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck-by hazards and fall hazards while working in a loader bucket: (a) On or about August 9, 2018 for the employees exposed to crushing hazards while performing maintenance and cleaning on a grain trailer who were lifted to heights of approximately nine feet by a Wacker Neuson WL38 Wheel Loader with a bucket attachment on it at the Scranton Equity Exchange located at 12 Hamilton Street SE in Scranton, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method of abatement to correct this hazard would be for the employer to follow the manufacturers recommendations for machine operation which clearly state, Carrying passengers with the machine is PROHIBITED. Carrying passengers on/in attachments/tools is PROHIBITED.
