29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.) At a residential construction site located at 2826 SE 8th St, Blue Springs, MO: Employees were exposed to struck-by and caught-in hazards. This was demonstrated when an employee was working inside an excavation while the owner was operating the backhoe, resulting in the employee suffering a severe injury in which their hip was fractured. In addition the employee was working inside an excavation that contained vertical walls with no means of protective systems in place and material placed next to the edge of the excavation. The employer failed to inspect the worksite on a regular and frequent basis which would have allowed for identification of hazards to employees.
