29 CFR 1910.269(r)(1)(iv): Branches that were contacting exposed energized conductors or equipment or that are within the distances specified in Table R-5, Table R-6, Table R-7, and Table R-8 were not removed using only insulating equipment. (a) 130 Pike Lane - An unqualified employee assigned line clearance tree trimming duties, removed a branch that was contacting an energized 34.5Kv line with his bare hand and was exposed to electrical shock hazards, on or about June 11, 2018. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records. 29 CFR 1910.269(a)(2)(iii)(A): Each line-clearance tree trimmer who is not a qualified employee were not trained and competent with the skills and techniques to distinguish exposed live parts from other parts of electrical equipment: (a) 130 pike lane - The employer did not ensure that non-qualified employees exposed to electrical shock hazards when tree trimming had the training, skills and techniques needed to distinguish exposed live parts from other parts of electrical equipment, on or before June 11, 2018 Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records. ---------------------------------------------------------------------------------------------- MODIFIED DUE TO FSA ON 5/2/19 TO: 29 CFR 1910.333(c)(2): "Work on energized equipment." The employer did not ensure that only qualified persons may work on electric circuit parts or equipment that have not been deenergized under the procedures of paragraph (b) of this section. Such persons shall be capable of working safely on energized circuits and shall be familiar with the proper use of special precautionary techniques, personal protective equipment, insulating and shielding materials, and insulated tools.
