29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) On or about December 7, 2017 and at times prior, five employees were working in an unprotected trench exceeding 9 feet in depth when the west trench wall collapsed. The trench had a history of water infiltration and was fissured. The competent persons permitted the employees to work inside the trench with the hazardous conditions present and without an adequate protective system. Three employees were partially engulfed up to their thigh while one employee was fully engulfed and suffered a broken hip and broken femur.
