29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. On and before October 11, 2017, the competent person(s) did not conduct adequate frequent and regular inspections of the mechanical equipment room and also the fresh air intake well where subcontractor employees were working from an aerial lift overhead and employees had access to work areas below the overhead work.
