29 CFR 1910.1026(f)(1)(i): Feasible engineering controls and work practices were not instituted to reduce and maintain employee exposures to chromium (VI) at or below the permissible exposure limit. Where feasible engineering and work practice controls were not sufficient to reduce employee exposure to or below the PEL, the employer did not supplement them by the use of respiratory protection: a) Weld shop. A welder performing TIG and MIG (flux core) welding on a stainless steel hopper was exposed to 13.7 micrograms hexavalent chromium per cubic meter of air, as an 8 hour time weighted average, which was 2.7 times the permissible exposure limit of 5 micrograms per cubic meter. Sampling was conducted for 407 minutes, with zero exposure assumed for 73 minutes not sampled. A Lincoln Electric Miniflex portable vacuum fume extractor was used but without the fume extraction gun which had previously been shown to reduce worker exposure below the action limit. Violation occurred on or about 5/1/17.
