29 CFR 1910.136(a): The employer did not ensure that each affected employee used protective footwear when working in areas where there was a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear would protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remained after the employer took other necessary protective measures: (a) Employees assembling, testing, dipping, painting and shipping transformers and exposed to the hazard of foot injury from falling transformers were not required to wear protective footwear to prevent injury from falling parts or materials.
