OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards: On or about 12/6/2016, in the warehouse, employees accessing the industrial racks were exposed to struck-by and crush hazards where the upright feet of the racking systems were visibly damaged by powered industrial trucks and were continued to be used at locations including but not limited to racks marked: a) A7-50-B-01/A7-48-B-01 b) A7-44-B2 c) A7-36_B-01 d) A7-27-B-03 e) A7-36-B-03 f) B3-55-A-01 g) B3-45-A-01 h) B3-39-A-01 i) B1-14-A-01 j) J4-18-B-02 k) J2-14-C-06 In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
