29 CFR 1926.65(f)(2)(ii): A medical surveillance program was not instituted by the employer for employee(s) who wore a respirator for 30 days or more a year, as required by 29 CFR 1926.103: (a) On and after 01/18/2016, at GE Power, Building 5, Areas 3 East and 4 East, for the laborers removing debris by hand and using HEPA vacuums and mercury vacuums to remove hazardous materials such as, but not limited to, elemental mercury, soil contaminated with mercury and wood contaminated with mercury. The employer did not provide medical surveillance to employees who wore respirators for more than 30 days.
