29 CFR 1926.65(g)(1)(i): Engineering controls and work practices were not instituted to reduce and maintain employee exposure to or below the permissible exposure limits for substances regulated either in 1926.55 or other pertinent sections of this part, except to the extent that such controls and practices are not feasible: (a) On and after 01/18/2016, at GE Power, Building 5, 4E floor, for the laborers removing debris by hand and using HEPA vacuums and mercury vacuums to remove hazardous materials such as, but not limited to, elemental mercury, soil contaminated with mercury and wood contaminated with mercury. Employees were exposed to mercury levels above the ACGIH TLV of 0.025mg/m3. The employer did not provide an appropriate combination of engineering controls, work practices, and personal protective equipment.
