29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. a) Route 40 and Salem Church Road, Bear, DE - The employer does not ensure that employees working on scaffolds are provided with safety training related to tubular welded frame scaffolding. This continuing violation was most recently observed on November 25, 2015, when employees performing stucco application were working from tubular welded frame scaffolds without receiving hazard reduction training from a competent person. The employer's ongoing obligation is to ensure that all employees working from tubular welded frame scaffolding receive instruction to assist in their understanding of hazard reduction techniques.
