29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) Route 40 and Salem Church Road, Bear, DE - The employer does not ensure that supported scaffolds are free of potential fall hazards. This continuing violation was most recently observed on November 25, 2015, when employees performing stucco application were working from tubular welded frame scaffolds in excess of ten feet above a lower level, which featured multiple unguarded edges. The employer's ongoing obligation is to ensure that all tubular welded frame scaffolding working levels are outfitted with the components necessary to prevent employees from falling to a lower level.
