29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: The employer is failing to protect employees from noise induced hearing loss in that; the employer is not implementing a hearing conservation program for employees at the GBW site location near 3100 S 30th Street, Omaha, NE 68107 where they engaged in rail tank car cleaning activities. Noise dosimetery showed employees to be exposed to noise levels exceeding the 85.0 dBA 8-hour-time-weighted average action level during previous inspections in 2015 and 2013 at the 302 Pierce Street location, where the employees were performing the same railcar cleaning tasks while entering the same types of rail tank cars and using the same types of equipment. Nebraska Railcar Cleaning Services, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.95(c)(1), which was contained in OSHA inspection number 925994, citation number 1, item number 1 and was affirmed as a final order on 17 July 2014, with respect to a workplace located at 115 Hickory Street, Omaha, NE 68108.
