Text For Citation: 02 Item/Group: 001 Hazard:

OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) In the warehouse area and in the truck loading area: On Feb. 25, 2015, and at times prior thereto, an employee was operating a Hyster powered industrial truck, Hyster Model S40XMS, S/N D010H03234B without a seat belt, because in the replacing the seat the wrong seat was procured and the bracket was not modified to accommodate the new seat. Note: Abatement certification and documentation ARE required for this item. The FMI-EPS, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 586720, citation number 01, item number 001A and was affirmed as a final order on Feb. 6, 2013, with respect to a workplace located at 280 Rose Street, Jerome, Idaho 83338.
