29 CFR 1926.651(i)(2): Excavation below the level of the base or footing of any foundation or retaining wall that could be reasonably expected to pose a hazard to employees was permitted: On or about January 25, 2019, and at time prior, before allowing employees to work in a trench or tunnels adjacent to and under a building, the employer did not ensure the stability of the excavation, the foundation or building. (a) A support system, such as underpinning, was not provided to ensure the safety of employees and the stability of the structure; or (b) the excavation was not in stable rock; or (c) a registered professional engineer had not approved the determination that such excavation work will not pose a hazard to employees.
