29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a. Employees installing roofing shingles at elevations of 6 feet or more above the ground are not being protected from fall hazards by a fall protection system. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on July 26, 2016, when employees installing roofing shingles on a 6:12 pitch roof at 2414 Oxmar Drive, Deland, FL 32724, were exposed to an 9.4 feet fall hazard above the ground in that they did not have a fall protection system installed. The Roof Depot, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 915808, citation number 01, item number 001 and was affirmed as a final order on August 14, 2013, with respect to a workplace located at 601 South Copeland Street, Tallahassee, FL 32307. Roof Depot of Central Florida, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1131612, citation number 01, item number 001 and was affirmed as a final order on April 25, 2016, with respect to a workplace located at 11613 Annie Mae Place, Jacksonville, FL 32256.
