29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about March 29, 2016, during the installation of a water line offset near 6684 Heisley Road, Mentor, Ohio, the employer did not ensure employees were protected from excavated material that posed a hazard of falling or rolling into an excavation, by placing and keeping the material at least 2 feet from the edge of a trench or by the use of a retaining device. AQUA OHIO, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.651(J)(2), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 949323, CITATION NUMBER 01, ITEM NUMBER 002, AND WAS AFFIRMED AS A FINAL ORDER ON OR ABOUT JANUARY 28, 2014, WITH RESPECT TO A WORK PLACE LOCATED AT 1226 ELK DRIVE, ASHTABULA, OHIO.
