29 CFR 1910.178(b)(12): The atmosphere or location was not classified as to whether it was hazardous or nonhazardous prior to the consideration of industrial trucks being used therein and the type of industrial truck required was not provided as in paragraph (d) of this section for such location: a) Ethanol Plant, Ethanol Pump/Loading Area - On or about July 24, 2019, the employer did not identify the area as a Class I, Division 2 hazardous location and use a forklift that was appropriate for the hazardous location, in that an unapproved Yale LP forklift was used to dispense gasoline from an intermediate bulk container into an ethanol tanker truck, thus exposing employees to flash fire hazards.
