Text For Citation: 01 Item/Group: 003 Hazard:

29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline. On December 28, 2017 at the jobsite located at 5559 Anne Marie Dr., lot # 45, employees were locating the sewer line in the south portion of a trench at a depth of approximately 16 feet, as standing water was present and protective measures and/or water removal methods were not utilized to protect employees against the hazards posed by water accumulation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
