Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls and stuck by hazards: On or about January 29, 2009 at the jobsite located at 9847 Maumelle Drive in Maumelle, Arkansas, employees were working from a personnel platform mounted on a Caterpillar rough terrain forklift and the platform was not secured to the forks, a condition that exposed the employees to the hazards of falls from elevation and to the hazard of being struck by the platform in the event it slipped off the forks. Among other methods, one feasible and acceptable means of abatement is to comply with the requirements of ANSI B56.6 Section 5.15.1 "Safety Standard for Rough Terrain Forklifts" which states: Be certain that the platform is securely attached to the lifting carriage and forks.
