29 CFR 1910.28(b)(3)(iv): The employer did not provide that each employee be protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used. a) Pedricktown South Sluice Box, Pedricktown NJ: Employees are exposed to fall hazards up to approximately 32 feet when walking and working at, near, and around three separate, unprotected, ladderway holes. At the time of their exposure, these employees were not using fall protection. On, about, and prior to 02/04/21. NOTE: IN ADDTION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
