29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: On or about June 10, 2016, Elmer Miller dba Miller Building Systems, does not require the use of any fall protection, while working from a supported scaffold which was lifted by a rough terrain forklift. This violation was most recently observed when four employees were working from a supported scaffold at heights in excess of 18 ft. and without fall protection, on a residential construction site in Mahomet, Illinois.
