OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a. On or about August 13, 2013, an employee climbing trees and working with a chain saw to cut trees was not a qualified arborist, exposing himself to a 51 feet fall hazard. Among other methods, one feasible and acceptable abatement methods to correct this hazard is to ensure that his employees are qualified arborists in accordance with ANSI Z133.1-2012.
