Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about January 25, 2010, and at times prior thereto, at the establishment located at 1100 West 15th Street, Fayetteville, Arkansas, employees were exposed to thermal burn hazards when walking or working near exposed steam and hot water lines in the following instances: a)In Line 2 & 3 Prep Area, steam and hot water pipes, approximately 180 degrees Fahrenheit, adjacent to the walking/working surface were not insulated or guarded. This condition exposed employees to the hazards of thermal burns. b)In Line 2, Blending Area, steam and hot water pipes, approximately 160 to 180 degrees Fahrenheit, adjacent to the walking/working surface were not insulated or guarded. This condition exposed employees to the hazards of thermal burns. c)In the Pie Line Area, on the Top Sheeter, steam and hot water pipes, adjacent to the walking working surface were not insulated or guarded. This condition exposed employees to the hazards of thermal burns. d)In the Blanching Area, the cover was off the temperature check point and hot steam and water, approximately 180 degrees Fahrenheit, was splashing onto the walking/working surface. This condition exposed employees to the hazards of thermal burns. Among other methods, two feasible and acceptable methods to correct this hazards include (a) insulate hot pipes/surfaces with insulating material and/or isolate the hot pipes/surfaces by providing barriers or guards to prevent employee contact as described in OSHA interpretation, dated 08/19/1998, "Workers must be protected from hazards of heated (hot) surfaces", which includes references to (1) national consensus standard "Standard Guide for Heated System Conditions that Produce Contact Burn Injuries (C1055-92)", issued by the American Society for Testing Materials (ASTM), and (2) "Preventing Burns from Insulated Pipes", Chemical Engineering, Vol. 88, No. 15 (July 27, 1981), (b) ensure all covers are in place where there is a possibility of hot water splashing out of a container. Pursuant to 29 CFR 1903.19(d), Pinnacle Foods must provide documentation that this violation has been abated within ten (10) calendar days of the date of this citation. OR IN THE ALTERNATIVE: 29 CFR 1910.212(A)(1): Machine guarding was not provided to protect operators and other employees from hazards created by hot surfaces: On or about January 25, 2010, and at times prior thereto, at the establishment located at 1100 West 15th Street, Fayetteville, Arkansas, employees were exposed to thermal burn hazards when walking or working near exposed steam and hot water lines in the following instances: a)In Line 2 & 3 Prep Area, steam and hot water pipes, approximately 180 degrees Fahrenheit, within reach of the walking/working surface were not insulated or guarded. This condition exposed employees to the hazards of thermal burns. b)In Line 2, Blending Area, steam and hot water pipes, approximately 160 to 180 degrees Fahrenheit, within reach of the walking/working surface were not insulated or guarded.
