Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a collapse: Tropicana Garage: Reinforcing steel was not accurately placed in accordance with industry practice and the structural and/or shop drawings; a)Welded Wire Fabric "mesh" was not embedded into the columns and shear wall along column line 1, P3 to P7, to develop its full strength and to reinforce the junction of the exterior beam to column and shear wall, on or about 10/30/03. b)One or more top longitudinal reinforcing bars of the exterior beam along column line 1, P3 through P7, were not placed through the columns to reinforce the junction of the beam and column, on or about 10/30/03. c)B4,9 reinforcing steel, a structural steel component required by the engineer and included in the structural drawings was not installed, on each floor along column line one, C.5 to F.6, on or about 10/30/03. ABATEMENT NOTE: Feasible and acceptable methods for abating this hazard are: 1)Comply with ACI 318-95 Building Code Requirements for Concrete and Commentary requirements. 2)Comply with the ACI Detailing Manual - Recommended Practices for Location of Bars Designated Only By Size/Spacing which describes the standard spacing for reinforcing bars when the spacing is not provided on the detailed drawing. 3)Comply with BOCA National Building Code/1996. 4)Follow shop and structural drawings and refer any discrepancies to the structural engineer of record. 5)Refer to CRSI. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.0
