Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) the hazards of being struck by aerial equipment in that on or about January 28, 2000, the areas where the Up-Right Lift was to be used was not free of drop offs, holes, slopes, bump and floor obstructions, debris, overhead obstructions and electrical conductors, hazardous locations,inadequate surfaces, wind, weather and other possible unsafe conditions. The employer failed to conduct a workplace inspection of the area where the Up Right Lift was to be used as required by ANSI 92.6 Section 7.8 which states that prior to use of the lift a check of the area shall be conducted for possible hazards, and the employer did not ensure employees were trained on the hazards associated with the use and operation of the Up-Right Lift in accordance with ANSI 92.6 Section 7.6 and the Up-Right Lift Instruction Manual as the employer did not train employees on the responsibilities as operators as outlined in Section 8 of ANSI 92.6 and/or on the hazards of setting up the lift on or near an inclined surface. The above was exacerbated in that the employer did not ensure that a copy of the operating and maintenance manuals was kept in the weather resistant storage compartment located on the Up-Right Lift. This condition prevented the easy access of safety information related to the lift. a) Abatement Note: Means of feasible abatement include, but may not be limited to: 1) training employees on the safe method of moving the lift from one point to another, and training them to recognize the hazards associated with working near drop offs or holes, slopes, bumps and floor obstructions, debris and overhead obstructions and electrical conductors, hazardous locations, inadequate surfaces, wind and weather and other possible unsafe conditions. 2) requiring the supervisor or other management person in charge of employees to conduct a workplace inspection of the area where the lift is to be used to identify the unsafe conditions mentioned above and requiring a copy of the operating and maintenance manual to be stored on the Up-Right Lift in the weather proof container located on the lift.
