29 CFR 1904.5(a): An employer is required to consider an injury or illness to be work-related if an event or exposure in the work environment either caused or contributed to the resulting condition or significantly aggravated a pre-existing injury or illness: a) Care One at Livingston Assisted Living, 76 Passaic Avenue, Livingston, NJ 07039 a) On or about April 9, 2020, the employer did not determine that the death of a Certified Home Health Aide who died of a confirmed case of COVID-19 on April 8, 2020 was work-related under circumstances where there had been both COVID-19 cases in the facility where the employee worked and also community transmission in the local area where the employee lived and worked and where the presence of COVID-19 cases in the workplace could have resulted in an exposure that either caused or contributed to the resulting condition.
