OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer is failing to protect employees from struck-by and caught between hazard. This was most recently documented on September 13, 2019 at 201 E. 1st St. Wilber Nebraska. The employer failed to follow the manufactures Safety and Operation instructions in that the vehicle transmission was not placed in park and the vehicle was started from a position other than the operators seat. Among other methods, feasible and acceptable methods of abatement are: a. Ensure that the vehicle transmission is placed in Park or neutral before attempting to start the vehicle. b. When starting or operate the tractor always do this from the operator's station.
