29 CFR 1926.1203(a): Before work began at a worksite, the employer did not ensure that a competent person identified all confined spaces in which one or more of the employees it directs may work, and identify each space that is a permit space, through consideration and evaluation of the elements of that space, including testing as necessary. (a) At the construction site on Belfast Keller and Interstate I-95, on or about June 19, 2019, the employer did not ensure that a competent person identified all confined spaces including permit spaces,as required, exposing employees to an oxygen deficient atmosphere.
