29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered: a. On or about July 16, 2018, in the jobsite at Villages of Seloy water and sewer main pipes installation project, the employer failed to implement a Hearing Conservation Program for the protection of employees using a handheld STIHL TS420 or TS700 gasoline powered concrete saw to cut concrete pipes where the employees were exposed to noise levels of 115 dBA.
