Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of caught-in or between while operating machines with the emergency stop button that were not readily accessible. Production area; machine operators were prevented from readily accessing the emergency stop buttons on the following thermoforming machines where the button was enclosed and covered by tape: 1. MC #15 Among other methods, one feasible and acceptable method for abatement is to discontinue allowing employees to cover the emergency stop buttons and ensure that the button are continuously operable and accessible. NFPA 79 - Electrical Standard for Industrial Machinery (2007 Edition) - 10.7 Devices for Stop and Emergency Stop. 10.7.1.1 Location and Operation 10.7.1.1 - Stop and emergency stop pushbuttons shall be continuously operable and readily accessible.
