Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while connecting/disconnecting trailers: The employer is failing to ensure that employees are not exposed to a caught between hazard. This was most recently documented on September 8, 2016 at 2:45pm at 3100 L Street, Omaha, Nebraska 68107. The employer failed to ensure that an employee was not exposed to a caught between hazard when connecting the truck to the trailer. Employee bob tailed the truck into the Greater Omaha Packing lot, backed up to a trailer and connected to the fifth wheel. The employee pulled the truck and trailer forward and to the right without raising the landing gear (the tractor was not in a direct line with the trailer). The employee made several attempts raise the landing gear with the crank handle. Once the employee was successful in raising the landing gear, the 53 foot refrigerated trailer and attached truck rolled down the 3 degree slope and towards the adjacent trailer creating a pinch point. The converging pinch point caught the employees body resulting in a fatal injuries. Among other methods, the following are examples of feasible and acceptable methods of correction: a. Ensure the parking area is level. b. Ensure the truck and trailer are positioned in a straight line when connecting/disconnecting is occurring. c. Ensure the parking area provides sufficient space between the trailers for the operators to move safely while performing coupling and inspection activities. d. Ensure trailer wheels are chocked and/or spring brakes are on, and ensure cargo is secured against movement prior to raising the landing gear. e. Ensure the driver sets the tractor parking brake and confirms the trailer brake is also set; places the transmission in neutral; and removes the keys when not in the drivers seat.
