29 CFR 1910.134(k)(1): The employer did not provide respirator training that would ensure each employee could demonstrate knowledge of items in section (i)-(vii): Rust-Oleum Corporation, at 715 Park North Boulevard, Clarkston, GA - on or about February 10, 2014, where employees were required to wear full face air-purifying respirators while working in the Paint Mixing area while adding paint constituents, including ammonium hydroxide and particulate containing silica, to mixing vessels. The employer did not provide training to ensure employees understood why the respirator was necessary and how improper maintenance can compromise its effectiveness; limitations and capabilities of the respirator; how to use the respirator in emergency situations; how to inspect, put on and remove, and perform seal checks; procedures for maintenance and storage; recognition of medical signs and symptoms that may limit the respirator's effectiveness; and general requirements of 1910.134. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
