29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: (i) Excavations are made entirely in stable rock; or (ii) Excavations are less than 5 feet (1.52m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in: a) South wall of house, 1429 Deepwood Road, Pittsburgh, Pennsylvania 15241: Observed on or about June 28, 2013, employees working in a 9 foot deep trench were not protected from cave-ins by an adequate protective system. The employees were exposed to crushed-by and engulfment hazards while digging a trench for the placement of piers beneath the footer of the house. The MWA Acquisitions was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.652(a)(1)), which was contained in OSHA inspection number 315561662, citation number 01, item number 002a and was affirmed as a final order on November 29, 2011, with respect to a workplace located at 630 Ray Drive, Carnegie, Pennsylvania 15106.
