29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: a) The employer did not provide a competent person to conduct required inspections where employees were exposed to the hazards associated with trenching and excavation work. Mango Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(1) which was contained in OSHA inspection number 558718, citation number 1, item number 1b, and was affirmed as a final order on October 3, 2012, with respect to a worksite located at 887 Spruce, Winnetka, Illinois. Mango Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(1) which was contained in OSHA inspection number 494678, citation number 1, item number 1c, and was affirmed as a final order on August 31, 2012, with respect to a worksite located at 138 Callan, Evanston, Illinois. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
