North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Caught by hazards. a)Maintenance equipment shed - the "John Deere" tractor model 5200 equipped with the stowable roll over protection bar was not equipped with a seat belt. Abatement note: One means of abatement would be to purchase and install a new seat belt equipment on all equipment with roll over protection devices according to the manufacturer's requirements. Reference: National Safety Council data sheet I-622 Reaf.85 page 3 figure 6 safety belts, attached to the movable portion of a seat, are necessary equipment on all tractors equipped with ROPS to keep the operators from being thrown against structure during an overturn. Warning label on frame of tractor at the road side entry point- "Danger Serious injury or death can result from rollovers - Use ROPS and seat belt at all times."rs
