Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the crane used in the scrap bin was being used for side lifts, resulting in the wire hoist rope wrapping outside of the hoist drum grooves, exposing employees to potential struck-by and crushing hazards. a) Kenton Iron Products LLC, Kenton, Ohio: On or about January 19, 2010, the employer did not ensure that the Series 700 Shaw-box crane, Model 72L05026S1522, Serial No. 06I11751, used in the scrap bin area of the foundry, was being properly operated by employees, in that the crane was being used for side pulls. The employer had replaced multiple damaged wire hoist ropes as a result of the side pulls and exposed employees to struck-by and crushing hazards if the wire hoist rope were to fail and drop its load while being used in this manner. Among other methods, one feasible and acceptable method to correct this hazard is to ensure the crane is maintained and operated according to the ASME B30.17-2006 "Overhead and Gantry Cranes". In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation ( using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
