Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazardous atmosphere(s) in confined space(s): Shaw House Project - On or about 02/20/2006, an employee suffered carbon monoxide poisoning when he entered a confined space manhole/underground utility vault and utilized a two cycle internal combustion powered Stihl TS 400 Cutquik saw to cut a cast iron pipe: Among other methods, one feasible and acceptable means of abatement would be to follow ANSI Z117.1 Safety requirements for Confined Spaces and identify confined space hazards, evaluate the confined space hazards, perform atmospheric testing, utilize personal protective equipment and/or ventilation, provide safe entry/exit, develop an emergency response plan, and utilize a confined space entry permit.
