Section 5(a(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by material falling from the open end of railcars, that had end gates that were defective or missing: a) Iron and Transportation Division 1) Transportation Department - Track #RA-2 - North Yard - Rail cars #2529 and #4254 had defective or missing end gates, observed August 29, 1989. b) Steel Producing Division 1) Open Hearth Department - South End - Track #H-9 - Open Hearth Yard - Rail cars #1994 and #2101 had defective or missing end a gates, observed August 2929, 1989. 2) Open Hearth Department - South End - Track #H-8 - Open Hearth Yard - Rail cars had defective or missing end gates, observed August 29, 1989. 3) Open Hearth Department - Open Hearth Yard - North End - Track #H-8 Rail car #1946 had defective or missing end gates, observed August 29, 1989. 4) Open Hearth Department - Track #H-17 - Stock House Yard - Rail car #4204 had defective or missing end gates, observed August 23, 1989. Abatement Note: One feasible and useful means of abatement among other methods, would be for the company to implement and enforce a safety appliance repair program to ensure rail cars are not used unless they are free from defects that may cause employees to become injured.
