29 CFR 1910.132(d)(1)(i): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment. a) On or about and at times prior to July 25, 2023, at the workplace located at 5843 Tower Drive; the employer did not select and require the use of personal protective equipment that would protect each employee from the hazards identified in the hazard assessment, such as but not limited to appropriate hand protection, exposing employees to skin irritation and chemical burn hazards from direct contact with hazardous chemicals and skin absorption hazards which include impact on target organ systems of the kidneys and gastrointestinal systems during handling of hazardous chemicals or puncture hazards without protection during on-going daily manual handling of wood boards.
