29 CFR 1910.28(b)(6)(i): The employer did not ensure that each employee less than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard. a. NOX US, LLC - Fostoria, Ohio: On or about May 4, 2022, the employer did not ensure employees who accessed the elevated platforms located adjacent to the C-1 calender, were protected from falling into dangerous equipment. Employees were exposed to falling into rotating parts of the equipment's rollers and power take-off shafts associated with the cooling rolls. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
