29 CFR 1926.503(c)(3): The employer does not retrain affected employees who already had been trained when inadequacies in an affected employee's use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill required by paragraph (a) of this section. (a) The employer does not ensure that previously trained employees are retrained when inadequacies in the affected employees use of fall protection are found. This violation was most recently observed at 1307 Mount De Chantal Rd, Wheeling, WV, where on or about March 29, 2022, employees performing roofing work while not using fall protection were not retrained by the employer, exposing employees to falls of 18-28 feet. Charm Builders, Ltd. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1530421, citation number 1, item number 2-a and was affirmed as a final order on 12/29/2021, with respect to a workplace located at 1021 Mount De Chantal Rd, Wheeling, WV.
