29 CFR 1910.28(b)(15): Walking-working surfaces not otherwise addressed. Except as provided elsewhere in this section or by other subparts of this part, the employer must ensure each employee on a walking-working surface 4 feet (1.2m) or more above a lower level is protected from falling by: (i) Guardrail systems; (ii) Safety net systems; or (iii) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: a) At New Steel: On or about May 9, 2018 and at times prior; the employer exposed his employees to fall hazards in that employees were allowed to climb the tops of metal plate storage racks and the tops of metal sheets in racks without fall protection exposing them to fall hazard of up to 8 feet to the concrete floor below.
