29 CFR 1926.850(a): An engineering survey was not performed by a competent person to determine the conditions of the framing floors and walls and the possibility of unplanned collapse of any portion of the structure prior to permitting employees to start demolition operations. (a)Hultgren Construction, LLC at 132-136 S. Phillips Ave., Sioux Falls, SD 57104: On or about and at times prior to December 2, 2016, prior to the start of demolition work the employer did not ensure a comprehensive plan was created for the demolition of the load bearing wall to include an engineering survey to be performed by a competent person to prevent unplanned collapse. The engineering survey would have determined and identified the conditions related to the floor framing and loading, wall construction determinations for load bearing properties, and the foundation condition and locations for Skellys and the Copper Lounge buildings. An employee working for Hultgren Construction was fatally injured as a result of the building collapse. This condition exposed employees to struck-by and crushing hazards during the demolition of the load bearing wall.
